Guidelines for Photo Usage

DAR members are not required to sign a permission form allowing their photos to be published, however, it is safest to have all members sign one to be filed with the chapter records. If a member leaves the Society, she could demand her image no longer be used. This could prove problematic in certain cases.

All non-DAR members must sign a permission form allowing their photos to be published anywhere, in perpetuity. Anywhere includes in a chapter newsletter, on Facebook, a chapter website, or in the local newspaper. The state form can be downloaded from the CSSDAR members’ website (members.californiadar.org) under the Forms and Publications link, Public Relations Committee. The signed form must be kept in the chapter files forever. Because the internet is “forever.”

The form is a blanket permission to publish (photo, name, hometown, school, etc.) and the use is “in perpetuity.” It is up to the person being photographed to give their permission.

Additionally, all minors, whether members of C.A.R. or not, must have a guardian sign a permission form to cover use of any photos. There are internet predators looking for kids online and we have to be very careful about making sure a parent or guardian approves of DAR’s use of a minor’s photos. With minors, no names or locations should ever be used. A single signed photo permission, from the minor’s guardian, will cover usage on Facebook, a web page, or a local newspaper.

The Veterans Administration (VA) also requires a government form to be signed prior to the taking of any photos. Due to HIPAA privacy laws, veterans are not allowed to be photographed without explicit permission of the facility. Those wanting to photograph at a veterans facility should check first with hospital administration regarding the rules.

In all cases, it is best to have a form signed at the time of the photography, even if you’re not sure the photo will be used. This way the chapter is covered in the event you decide later to use it. Avoiding names and exact locations also provides further protection to all involved. When in doubt, err on the side of cautious.
